TERMS AND CONDITIONS

By commissioning me in any way, you agree with the following terms and conditions. Latest Revision as of January 1st, 2022

I. Requesting a Commision
A. Sushipop (the artist) retains the right to decline any commission request they deem inappropriate.

  1. Repeated inappropriate requests can result in the conditions stated in section VII-A (denial of service)

B. Sushipop retains the right to change / modify color palettes provided by the client in order to better match their artstyle.
C. Commission slots are on a first pay, first serve basis. Failure to pay an upfront cost before others may result in the loss of a commission slot.

II. Payment
A. Commissions are to be paid in full, upfront, after the parameters of the commision are discussed between the client and artist.
B. Commissions are to be paid in USD through PayPal via Friends and Family

  1. On a case to case basis, other payment methods may be allowed.

III. Process
A. Works in Progress (WIPs) will be provided between different stages of the commision.
B. Commissions are usually finished within a month.

  1. This is subject to change, based on the artist’s personal life, school, health, and other events which could result in the inability to work on the
    commission.

IV. Post Commision
A. The client retains the right to request minor changes to the artwork after the commission is finished within a period of one month, including minor changes to lineart, color, and cropping.

  1. Any change which requires Sushi Pop to entirely recreate or draw a new portion of the commission may result in an extra charge.
  2. The client is also allowed to make minor changes to the artwork themselves if given the source .csp file and permission from the artist.

V. COPYRIGHT / USAGE POLICY
A. Sushipop (the artist) holds all commercial and private usage rights to the artwork created, as well as any derivative works. Therefore, the artist retains the right to use the copyrighted work in (but not limited to) the following circumstances:

  • To promote Sushipop as an artist or brand.
  • Posts to any website
  • Use in publications including (but not limited to) collections, books, magazines / zines, brochures, business cards, etc.
  1. In the case of a single commission being used commercially, Sushipop will contact the client in question to request usage of their character for commercial use.

B. The client holds a Creative Commons Attribution-NonCommercial-NoDerivs (CC BY-NC-ND) license to the works created for them by Sushipop.

  1. This license allows the client to share and download the work, but restricts them from creating public derivative works or modifications to the work.
  2. Where possible, the CC BY-NC-ND label should be displayed alongside the artwork.

C. The client is not allowed to use the artwork commercially (making money off of it) in any way.
D. The client is not allowed to claim credit for the artwork itself, but claim credit for the character(s) used in the piece.
E. The client is not allowed to remove any watermarks which indicate the work was created by Sushipop.
F. The client is prohibited from using the copyrighted artwork in any way related to cryptocurrencies, p2p blockchain, or related technologies. This includes but is not limited to:

  1. Minting the artwork as an NFT (Non-Fungible Token) or saving / storing it on a blockchain of any type.
  2. Minting / publishing the artwork to NFT focused websites such as Opensea.
  3. Minting an NFT which contains a link that directs to the artwork in any way whatsoever.

G. Any violation of the above terms is considered copyright infringement, and may result in DMCA takedown.

VI. REFUND AND CANCELLATION POLICY
A. Sushipop retains the right to cancel and refund the payment back to the client via PayPal at any time.
B. The client has no right to cancel a refund issued by the artist.
C. The client has no right to demand a refund unless agreed upon between the client and artist.
D. The client is by no means allowed to file a chargeback for any payments on any platform used in the commission

  1. Doing so will result in the conditions stated in section VII-A.

VII. VIOLATION OF TERMS
A. In the case of the client violating any of the above terms, the following conditions will apply:

  1. The client will lose all licenses to any and all works created for them by Sushipop.
  2. The client will permanently lose permission to commission Sushi Pop in the future for similar, or different works.
  3. Sushipop will retain the rights to the artwork as stated above.
  4. Sushipop will retain the right to file a complaint or report to any of the services used in the process of commissioning them.

Any of the above terms can be subject to change if agreed upon between Sushipop and the client before the commission payment is made.
